Schneitter's Swiss Oaks Rules, Restrictions & Regulations for the Homeowner Association  
 
ITEM DESCRIPTION CC&R COST / PENALTY / FINES
Rules & Regulations All owners must comply with rules & regulations that are adopted by the Association as they are modified, amended and construed from time to time. 6.04, Art. 4.9.01  
Enforcement Failure to comply shall be grounds for an action to recover sums due for damage or injunctive relief or both. 7.10, 16.01 Individual Penalties and Fines are listed below.
Air Conditioning Compressors No Air Conditioning Compressors are allowed to be installed with prior written notice by the association. This is consider a change to the exterior. All requests will be handles on a one-one-one basis. 7.05 Warning with 30 days to comply or Cost & Time to remove billed to the unit owner.
Annual / Monthly Dues Annual dues are divided into twelve equal payments and are due by the 15th of each month. 11.01  
Barbecues Only clean burning gas barbecues allowed. No open flames from wood chips or fire pits. Adopted 2010 Warning on the 1st offense, Fine assessed to the unit owner on the 2nd offense.
Business, Industrial or Commercial Use No unit shall be used for any business, industrial, or commercial purpose. 6.01 Fine determined at time of offense.
Car Washing Owners may not wash their vehicles within the community. Adopted 2018 Warning on the 1st offense, $50 fine on any offenses after the first.
Clubhouse May not be in the clubhouse past the posted hours. Adopted 2011 $50 per person
Clubhouse - Alcohol No alcohol allowed in the Clubhouse Adopted 2011 $500 per occurrence. No prior warning needed.
Clubhouse - Pets No pets allowed in the Clubhouse Adopted 2011 Warning on the 1st offense, $50 fine on any offenses after the first.
Clubhouse - Reservations Banquet room may be reserved prior to the day of the event through the HOA management office   $200 fully refundable deposit if no additional cleaning or maintenance is required.
Clubhouse Key - Purchase
Clubhouse Access is with a HOA Key Fob, which can be purchased at the HOA office during business hours. Lost keys will require the purchase of a new key. Non-working key fobs can be turned in for a working key card.

Decks - Walking Surfaces Paint & Stain Material will be supplied or reimbursed by the HOA. Labor to be provided by the unit owner.    
Dishes - Television / Internet No television or internet dishes are allowed to be installed without prior written notice by the association. This is consider a change to the exterior. 7.05 Warning with 30 days to comply or Cost & Time to remove billed to the unit owner.
Electric Vehicles Owners (and tenants) who own electrical vehicles and use common area outlets, will be charged for the use of electricity on the common area meters. Adopted 2020 $25 minium monthly fee based on usage.
Garbage Cans All items (i. e. boxes, furniture, trees) must be placed inside of the garbage cans. Adopted 2011 $100 per occurrence
Hot Tub No one under the age of 16 may be use the hot tub / spa without adult supervision. No alcohol allowed in the hot tub area. Adopted 2011 $500 per occurrence
Insurance Comprehensive Liability Insurance for $1.0M. 5th Amend. 12.05  
Keys to Owners Units Owners must have an emergency key on file with the property manager or a letter of liability stating manager will not enter the home and may take proper actions if needed to for true emergencies.    
Landscaping Alterations All changes to the landscaping must be approved by the HOA board and have a written petition signed by all neighbors within a building and in surrounding buildings that are effected by the change request PRIOR to any changes being made.

Late Fees Association may determine a late fee if not paid on time. Monthly fees are to be paid by the 15th of each month. 11.02.d $20 for 30 days late, $40 for 60 days late, $60 for 90 days late + lien.

Leasing / Rentals HOA / Management MUST be informed and provided contact information (name, phone #'s, and e-mails) of all adult tenants.

$500 fine for not providing this information prior to tenant's move in date.
Leasing / Rentals Not less than the entire unit, may not rent individual rooms. HOA/Manager must be notified of property being rented and who the tenants are. 6.02 $500 per occurrence.
Leasing / Rentals Owners shall be responsible for compliance by tenants. 2nd Amend. 6.02  
Leasing / Rentals Shall be for a term not less than thirty (30) days. 2nd Amend. 6.02 $500 per occurrence.
Lien Association may lien individual properties for outstanding dues. 11.04 Cost of lien + $50/hr. rate for managers time.
Littering All trash, waste and liter must be disposed of into the community or personal trash receptacles. Adopted 2011 $100 per occurrence
Mailbox Key Mailbox locks are issued through the HOA office and coordinated with the Midway City Post Office.

New Owner Set-Up Fee Fee charged at time of closing and usually collected at time of closing for setting up a new owner into the HOA systems. Adopted 2010 $200 for Setup & $50 CH Deposit = $250
No Alterations Owners may not change or anything to the exterior of the building without prior written consent from the Association. 7.05 Cost (time & materials) for repair billed to the unit owner.
No Noxious or Offensive Activities No activities or improvements, which create an unreasonable disturbance or annoyance to owners. 7.01 Will be determined at time of offense.
No Smoking “No Smoking” policy within the entire Swiss Oaks Community. Adopted 2011 There is “no-tolerance” enforcement of this rule and any unit (owner, tenant, or guest) in violation will immediately be assessed with a $150 fine.  Subsequent violations will be subject to a $500 penalty.
NSF Non Sufficent Funds and return of HOA monthly check.   The bank cost will be passed on to the owner. Current bank fee is $25.00.
Overloading of Building Weight can not be exceeded or any other item that would shake or vibrate the building. 7.07 Warning with 15 days to become compliant. Cost of removal billed to owner after warning.
Parking
All vehicles must be used daily. Stored vehicles may be left in/on garages, driveways or underground assigned parking stalls.  They may not be stored in common area parking.
 
Owners may not park in another owner's assigned parking stall without permission.

Parking - Boats & Trailers Boats, RVs or any type of trailer may not be parked in the common area without prior approval by the HOA or it's manager. A temporary dated authorized tag will be distributed and must remain on the trailer while parked within  Swiss Oaks for the amount of time specified, not to exceed 5 consecutive days. Extensions may be granted with prior approval by the HOA or its manager.

Parking - Roads No parking on the roads or in front of garages that are on roadways. Adopted 2006 Item will be towed or removed immediately at the owners expense and/or $50 fine on first offense, 2nd offense $100, 3rd and additional offenses fined at $150 per occurrence.
Parking - Underground Garages Owners must park in their designated areas. Visitor parking spaces are on a first come bases. Owners may not use visitor places as a second parking space for additional vehicles. Adopted 2010

Parking - Winter All vehicles must be removed from unplowed common area parking stalls by 7 AM on snow days. These vehicles maybe moved to another common area parking stall if that area has been plowed and cleared of snow.  Otherwise the vehicles must be removed from the property. Adopted 2019

Pet Noise Pets noise that disturbs others is considered a noxious and/or offensive activities

Pet Unattended All pets must be accompanied by there owners at all time and may not be left unattended in the common and limited common area. Adopted 2011 Warning on the 1st offense, $50 fine on any offenses after the first.
Pet Waste All waste material must be removed. 7.03 $100/pile removed
Pets Pets are not allowed in the common area without a leash. 7.03 Warning on the 1st offense, $50 fine on any offenses after the first.
Sanitary Units If personal units are not sanitary the HOA may enter the home after 15 days notice. 5.02 Cost for Correcting Issue
Security Cameras No cameras are allowed int he common or limited common areas. The only cameras approved are exclusively doorbell cameras, in place of doorbells. Adopted 2024 Camera(s) will be removed by the HOA and the property owner will be fined $250 per occurrence and/or camera.
Signs No signs (sale, rent, political) allowed in windows, on doors or other exterior surfaces. Without prior written consent from the Association. 7.02 Management will remove without notice if prior written approval has not been granted.
Solicitation No Soliciting allowed within the community. Adopted 2011 $100 per occurrence
Speeding Speed limit within the community is 15 MPH Adopted 2011  
Storage - Underground Garages No owner except for those who live in the building may use the common area. Any item left stored in the common area must have prior written approval from the Association. Adopted 2010 Warning with 15 days to become compliant. Cost of removal billed to owner after warning.
Storage & Obstruction No obstruction or storage of any item to be left in the common area without prior written notice. 7.06 Warning with 15 days to become compliant. Cost of removal billed to owner after warning.
Structural Changes No changes may be made to the exterior or common areas of the building or community without prior written approval from the HOA. THIS INCLUDES TELEVISION AND INTERNET DISHES. 7.05 30 Day Notice and/or Fine.
Vandalism, Damage, Dangerous Activities Any intentional activity that damages destroys or causes additional maintenance to the project 7.08 Cost of repair + a $1000 Fine.
Wild Animal Feeding For the safety of the community and the animals with direction from DNR. Homeowner's may not feed wild animals. Adopted 2023 Notice with $100 fine per occurrence.
Window Coverings No exterior window covering unless approved by the association. All interior window coverings seen from the outside must be white, neutral color or approved by the association. 7.04 Warning with 30 day to remove and become compliant. If Association has to remove, cost of time and materials will be billed to the owner.
